This essay reassesses the German-Jewish social and cultural critic, Walter Benjamin's famous, yet widely misunderstood thesis of the aestheticisation of politics with reference to the development of the mass media and the crisis of democracy. I argue that his thesis of the aestheticisation of politics represents the focal point of his account of both the crisis of liberal democracy as a deliberative and representative political system and the emergence of fascism as a form of direct political communication between a political power and the public. My examination of Benjamin's analysis of the interplay between fascist politics and the mass media leads to a wider critical consideration of the function of political spectacle in the media age. In so doing, I seek to draw out its theoretical relevance for our critical understanding of the linkage between new media and democracy, be it 'new' or 'old' democracy.
There is a widespread tendency to see the perils of postsocialism in the revival of the ghosts and myths from the past—namely ethnocentrism, nationalism, exclusiveness, bickering, collectivist-authoritarianism, expansionist chauvinism, and victimisation. I suggest that postsocialism's perils rest with a myth from the future, namely, the myth of capitalism. Those perils, I argue, are rooted in the fetishisation of capitalism by the postsocialist societies as a reflection of their deeply ingrained teleological way of perceiving the future. Political leaders are taking advantage of this situation by putting themselves in the position of those who would lead toward such a utopia. As a consequence, individual freedoms are sacrificed at the altar of communitarian bliss. I suggest that the only hope that we have to secularise the newly re-religiosised postsocialist societies rests with intellectuals.
'Tacit consent' has long interested historians of political thought and political philosophers, but its nuances nevertheless remain unappreciated. It has its roots in the Roman law concept of a 'tacit declaration of will'. Explicating this concept allows a new conception of tacit consent to be proposed, which I term the 'tacit declaration of consent'. The tacit declaration of consent avoids both the triviality of common sense views and a weakness in Hobbes' account. Unlike other contemporary philosophical accounts, it avoids fictions and meets the condition of intentionality. Furthermore, it also advances understanding of the sorts of claim offered by proponents of a tacit consent-based theory of political obligation, whilst facilitating a more radical critique. The tacit consent-based theory of political obligation is not simply limited in application, but indefensible. It unwarrantedly transposes onto tacit consent the potentially fictional character of declarations of will.
Even where an act appears to be responsible, and satisfies all the conditions for responsibility laid down by society, the response to it may be unjust where that appearance is false, and where those conditions are insufficient. This paper argues that those who want to place considerations of responsibility at the centre of distributive and criminal justice ought to take this concern seriously. The common strategy of relying on what Susan Hurley describes as a 'black box of responsibility' has the advantage of not taking responsibility considerations to be irrelevant merely because some specific account of responsibility is mistaken. It can, furthermore, cope perfectly well with an absence of responsibility, even of the global sort implied by hard determinism and other strongly sceptical accounts. Problems for the black box view come in where responsibility is present, but in a form that is curtailed in one significant regard or another. The trick, then, is to open the box of responsibility just enough that its contents can be the basis for judgements of justice. I identify three 'moderately sceptical' forms of compatibilism that cannot ground judgements of justice, and are therefore expunged by the strongest 'grey box' view.
